Freehold transactions
There are three general stages involved in the sale of a freehold title which includes the pre-exchange, exchange and completion stages. At the pre-exchange stage, contracts are drafted and negotiated and offers on the property are accepted. At the exchange stage, the buyer and seller’s solicitors exchange contracts and searches of the property are conducted. Searches are a process carried out to find out further information about a property and the surrounding area and include local (planning permissions and planned developments, sewage and drainage and mining searches (subsidence risks). There are contractual penalties for pulling out at the exchange stage. At the completion stage, the transaction is complete and all monies are transferred from the purchaser to the seller. The purchaser is registered at the Land Registry and allowed to take possession of the property.
